URW Community Federal Credit Union and the Credit Union Automated Teller Machine (ATM) Access Cards
AGREEMENT AND DISCLOSURE
Your retention or use of the Credit Union card constitutes an agreement between you, and any joint owner of this account, and URW Community Federal Credit Union.
You may use your URW Community Federal Credit Union ATM Card in any ATM machine bearing the CIRRUS® logo as well as MAESTRO® logo, only after you have received your Personal Identification Number (PIN). The ATM Card and PIN will allow you to:
1. Withdraw the available balance from your share or share draft/checking accounts in amount as much as $300.00 per day in cash, however, each machine may have a lower cash limit which may not be controlled by the credit union.
2. Inquire on share or share draft account balances.
3. Transfer funds on URW COMMUNITY FEDERAL owned machines.
Cash withdrawal amounts from ATM machines bearing the CIRRUS® Logo must usually be in multiples of$10.00. And, may have additional per visit limitations imposed by the machine's owner. Your daily cash withdrawal limit of $300.00 is established by U.RW. 831 Members Federal Credit Union and may be in creased or decreased at any time without notice. Withdrawals cannot be made at an ATM if any loan account is in default.
TERMS AND CONDITIONS
ALL CARDHOLDERS AND/OR CARD USERS HEREBY AGREE:
1. To abide by the Rules and Regulations, as amended, of URW Community Federal Credit Union, CIRRUS®, and MAESTRO® relating to the use of this ATM card;
2. THAT the Credit Union ATM Card(s) issued by URW Community Federal Credit Union are the property of the credit union and will be surrendered immediately at URW Community Federal Credit Union's request;
3. THAT URW Community Federal Credit Union, CIRRUS®, and MAESTRO® may follow all instructions given to machines by the cardholder;
4. THAT the Personal Identification Number (PIN) issued by URW Community Federal Credit Union is for your personal security to prevent unauthorized use of your account. The PIN is confidential and MUST NOT be revealed to any party not authorized on this application or recorded on the card; and
5. WE will not be required to complete an Automated Teller Machine Card cash withdrawal, checking withdrawal or transfer between accounts, if you do not have enough funds in the account to cover the transaction. You agree not to use your Automated Teller Machine card and PIN number for a transaction that would cause a withdrawal or transfer from a type of account which we do not have. We will not be required to complete any such transaction, but if we do so, you agree to pay us the excess amount or the amount improperly withdrawn or transferred, immediately upon request. We also reserve the right to transfer from other open accounts at the Credit Union on which you are a joint owner. (If your account is overdrawn through a transaction on the Automated Teller Machine, you will be charged $10.00 for each such insufficient transaction.)
6. Failure to abide by terms and conditions may result in litigation. If we go to court for any reason, it is hereby agreed and stipulated we can use a copy, photograph, microfilm, microfiche, or any document to prove what you owe or that a transaction has taken place, and any copy, photograph, microfilm, or microfiche, will have the same validity as the original document. If we file a lawsuit to collect whatever you owe us, you will pay our reason able expenses, including attorney's fees.
7. We may also refuse to complete your Automated Teller Machine transactions when necessary for security reasons.
ELECTRONIC FUNDS TRANSFER DISCLOSURE
An Electronic Funds Transfer (EFT) is any transaction involving funds initiated through an electronic terminal or telephone authorizing U.RW. 831 Members Federal Credit Union to debit or credit your account.
TRANSACTION FEES
During the hours that the automated teller machines are accessible to the members, you as well as any other person authorized can use your Automated Teller Machine Card and PIN number at an ATM machine for the following purposes, to the extent the law allows and the machine is able to perform the transaction:
Transactions for purposes of charging fees are defined as withdrawals and Inquiries.
Fees for Cash Withdrawals and Inquiries
A. Transactions performed on credit union OWNED machines are considered “on us” transactions.
• 10 FREE transactions per month for cardholders that provide direct deposit of their net pay to the credit union. The 10 free are limited to only 5 at foreign machines.
• 5 FREE transactions per month for cardholders not providing direct deposit of their net pay to include inquiries, and withdrawals. Transaction costs above these limitations will be $1.00.
B. Transactions done on machines NOT owned by the Credit Union are considered “foreign” transactions.
• 10 FREE transactions per month to include inquiries and withdrawals for those card holders that provide direct deposit of their net pay to the credit union. The 10 free are limited to only 5 being done at foreign machines.
• Cardholders with direct deposit but exceeding the 10 free transactions will pay a $1.00 per transaction as well as $1.00 for exceeding 5 transactions at a foreign machine
• Cardholders not providing direct deposit of net pay will pay $1.00 per transaction.
DEPOSITS
You can use your Automated Teller Machine Card and PIN number at the credit union ATM located at the Arnett Blvd. location to make deposits to your accounts. A one (1) day hold will be placed on all deposits for verification purposes. Further holds may apply, please refer to our funds availability policy.
CARD REPLACEMENT
Cards reissued due to abuse/misuse will be provided for a fee of 10.00, subject to the surrender of the old card to URW Community Federal Credit Union.
Cards may be replaced which have been lost or stolen for a fee of $10.00 provided the member notifies URW Community Federal Credit Union immediately upon discovery of the loss and provided that any unauthorized use of the card has not resulted in a loss to the Credit Union. Lost cards will be replaced after a suitable waiting period in order to give the credit union the opportunity to determine if the card has fallen into the wrong hands and if any unauthorized transactions have occurred. In the event a card is lost or stolen more than one time, a new card will generally not be reissued.
PIN REPLACEMENT
A charge of $1.50 will be charged at the time of request.
CARD REVOCATION
URW Community Federal Credit Union reserves the right to revoke any issued Credit Union ATM card if any of the following occur:
1. Unauthorized or authorized use of the card which results in a monetary loss to the Credit Union;
2. Loan delinquency with the URW Community Federal Credit Union and;
3. Forced closure of a URW Community Federal Credit Union draft account due to accumulated unpaid return check fees.
NOTICE OF LIABILITY
Tell us AT ONCE if you believe your card or PIN has been lost or stolen. You may call URW Community Federal Credit Union at (434) 793-1278 during business hours. Tele phoning is the best way of keeping your possible losses down. If you notify us within two (2) business days, you can lose no more than $50.00 if someone used your card or PIN without your permission. If you do NOT notify us within two (2) business days after you learn of the loss of theft, and we can prove that we could have stopped some one from using your card and PIN without your permission had you told us, you could lose as much as $500.00. Also, if your statement shows transfers that you did not make, notify URW Community Federal Credit Union immediately. If you do not tell us within sixty (60) days after the FIRST statement which reflected the unauthorized transaction was mailed to you, you may not get back any money you lost. MULTIPLE CARDS
Cards may be issued to any account owner or joint owner of legal age who qualifies. Legal age, for the purpose of receiving an ATM card, will be considered to be age 18. Multiple cards may be issued to joint owners on the account(s) to be accessed only if the first account owner signs the ATM application with the second account (joint) owner to receive a card. Cards must be embossed in either the name of the account owner or the joint owner. Only one card per account owner is allowed to be issued and outstanding at any time for persons under 18 years.
BUSINESS DAYS
Our business days are Monday and Fridays 7:30 am . to 5:00 p.m. ; Tuesday thru Thursday 9:00 am, to 5:00 p.m. (Eastern Standard Time), excluding holidays.
LIABILITY FOR FAILURE TO MAKE TRANSFERS
If we do not complete a transfer to or from your account on time or in the correct amount according to our agreement with you, we will be liable for your losses or damages. However, there are some exceptions. We will NOT be liable, for instance if:
1. Through no fault of ours, you do not have enough money in your account to make the transfer;
2. The money on your account is subject to legal process, such as garnishment or attachment, or if the ac count is pledged as security for a loan;
3. The ATM where the transaction occurred did not contain enough cash to complete the transaction;
4. The ATM was not working properly and you knew about the breakdown when you started the transaction;
5. Circumstances beyond the reasonable control of the credit union, such as fire, flood, electrical failure, failure of a paying agency to deliver direct deposit by the payment date, etc., prevented the completion of the transaction.
ERROR RESOLUTION PROCEDURE
If you think your statement is wrong or if you need more information, you should telephone us at (434) 793-1278, or write us at 539 Arnett Blvd. , Danville , VA 24540 , as soon as you can. We must hear from you no later than 60 days after we have sent the FIRST statement on which the problem or error appeared. Please provide us with the following at the time you have an inquiry. Tell Us:
• Your name and account number
• Describe the error or transfer in question and explain as clearly as possible why you believe it is an error or why you need more information.
• The dollar amount of the suspected error.
• If you tell us orally, please send us your question or complaint in writing within 10 business days. We will inform you of the result of our investigation within 10 business days after we hear from you and will correct it promptly. If we need additional time, we may take up to 45 days to further investigate your complaint or question. In this event, we will credit your account within 10 business days for the amount in question, so that you will have the use of the money during the investigation period. We may not credit your account unless we receive your complaint or question in writing within 10 business days.
• If our investigation reveals there was no error, we will send you a written explanation within 3 business days after we finish our investigation. You may ask for copies of documents that we used in our investigation.
RECEIPTS AND ACCOUNT STATEMENTS
At the time you use the ATM you will receive a receipt describing the transaction you have made. We strongly recommend that you retain these receipts for comparison to the information provided on your periodic statement.
If you have an active credit union share draft checking account, you will receive a monthly statement. If you do not have a share draft checking account with us, you will receive a quarterly statement.
DISCLOSURE OF ACCOUNT INFORMATION
We will disclose information in your account to third par ties about your account or the transactions that are made:
1. When it is necessary to complete a transfer; or
2. To verify the existence or condition of your account for a third party such as a credit reporting agency or merchant;
3. To comply with a government agency or court order;
or
4. If you give us written permission.
CHANGES IN TERMS AND CONDITIONS
This agreement is subject to change, without notice, to conform with Rules and Regulations as set forth by government agencies, CIRRUS®, MAESTRO® and URW Community Federal Credit Union. All notices provided will be sent to you at your last known address as reflected on your ac count with this credit union. We reserve the right to change, without notice, the limits on the types and amounts of transactions which may be done with your card(s).
